Terms of Service
Last updated: 15 August 2026
These Terms of Service are a binding agreement between you and Jaylen Bell, doing business as MIMO. They govern the MIMO website, browser application, and any MIMO mobile application that links to them. By creating an account, checking the acceptance box, or using MIMO, you agree to these Terms and the Privacy Policy. If you do not agree, do not create an account or use MIMO.
What MIMO is, and what it is not
MIMO is a web and mobile service marketplace and business-management tool. It helps customers discover, request, book, pay for, and review services offered by independent service providers. It helps providers advertise unlimited services, manage requests and appointments, receive payments through Stripe, track business activity, and use the complete solo-provider toolkit free of charge. Optional paid plans add collaboration capacity for businesses and teams that need more than one business user.
The provider—not MIMO—is the seller and merchant for each customer service transaction. MIMO does not perform, control, supervise, guarantee, or insure provider services. Providers are not MIMO employees, agents, joint venturers, or representatives. MIMO does not guarantee a provider’s identity, licensing, insurance, qualifications, availability, pricing, conduct, or work quality.
Accounts
- You must be at least 18 and able to enter a contract.
- Give accurate information and keep it current.
- Your password is yours to protect, and you are responsible for what happens under your account. Tell us at once if you think it has been compromised.
- Do not share credentials, sell or transfer an account, impersonate anyone, or create an account for a person who has not authorized it.
- A business owner is responsible for authorized members added to the business and for promptly removing access that is no longer appropriate.
If you are a service provider
- You independently set and honor your services, descriptions, prices, availability, service area, customer commitments, and cancellation practices.
- You are responsible for the work you perform and for every license, permit, registration, authorization, insurance policy, safety practice, and tax your business or trade requires.
- The customer records you create are your responsibility. Only store details you have a legitimate reason to hold, and handle them lawfully.
- Publishing to discovery makes your business name, description, services, prices, city and region publicly visible.
- You must give customers accurate seller, contact, receipt, refund, and tax information and must not represent that MIMO performs or guarantees your services.
- You authorize MIMO to send authenticated instructions to Stripe for customer charges, approved refunds, and any optional MIMO collaboration-plan subscription you choose.
If you are a customer
- Give accurate details when you request work, including the address and what is needed.
- Review the provider, scope, final price, timing, and refund terms before paying. Your service agreement is with the provider.
- Provide safe and lawful access to the service location and disclose conditions reasonably relevant to the work.
- Raise service-quality, scheduling, cancellation, or price issues with the provider first. MIMO may supply platform records but does not decide the merits of the underlying service dispute.
- Do not use MIMO to request anything unlawful.
Acceptable use
Do not:
- break the law, or use MIMO to help anyone else do so;
- harass, threaten or discriminate against another user;
- post false, misleading or fraudulent listings, requests or reviews;
- attempt to access another account or business’s data, probe or disrupt the service, or bypass its security;
- scrape the service, copy listings in bulk, resell access, or use automated means not expressly authorized by MIMO;
- upload malware, or content you have no right to share.
- use MIMO payment tools for sham transactions, money movement unrelated to a real service, fraud, or unlawful activity; or
- alter, bypass, falsify, or manipulate a service price, connected Stripe account, MIMO plan, payment status, refund, subscription, or Stripe record.
We may suspend or close accounts that break these rules. Where it is reasonable we will explain why first.
Stripe payments and MIMO’s zero-commission policy
MIMO uses Stripe to process customer payments, provider payouts, refunds, disputes, and provider subscription charges. Complete payment-card, bank-account, and payout credentials are submitted directly to Stripe and are governed by Stripe’s agreements and privacy practices. MIMO does not receive or store complete card or bank credentials.
- Customer payments are created as direct charges on the provider’s connected Stripe account using the final agreed price stored by the MIMO server. The provider’s business information may appear on Stripe Checkout, receipts, payment records, or the customer’s financial statement.
- The customer authorizes Stripe to charge the selected payment method for the final price shown before payment.
- MIMO does not deduct an application fee, marketplace commission, lead fee, or separate MIMO surcharge from a customer service payment. MIMO’s fee for each customer service payment is 0% on every plan.
- The provider receives the customer service payment after Stripe processing fees, refunds, disputes, reserves, negative-balance adjustments, and any other amounts Stripe is authorized to deduct under the provider’s Stripe agreement.
- Stripe controls authorization, payment-method availability, processing, reserves, fund availability, payout timing, account restrictions, and bank deposits. A payment is paid in MIMO only after an authenticated Stripe result is applied.
| Provider plan | MIMO fee per customer service payment |
|---|---|
| Free | 0% |
| MIMO Pro | 0% |
| MIMO Business | 0% |
| MIMO Teams | 0% |
The final service amount and provider connected account are calculated and locked by MIMO’s server when customer payment begins. A later plan change does not retroactively alter a locked payment. A provider’s plan and billing interval do not change MIMO’s 0% service-payment fee.
Stripe processing fees are not MIMO fees. Stripe generally deducts its own processing costs from the provider’s connected account under Stripe’s agreement with that provider. MIMO cannot waive, refund, or control Stripe’s fees, reserves, or other Stripe-authorized adjustments.
Customer service refunds and disputes
- A customer may submit one refund request for an eligible paid job during the ordinary refund window. A request does not move money or guarantee a refund.
- The ordinary refund window ends seven calendar days after the later of successful payment and job completion or cancellation. Before the job ends, that seven-day period has not started.
- The provider decides whether to approve a full refund, approve a partial refund, or decline the request, subject to applicable law. Business owners and admins may also initiate an eligible refund through MIMO.
- Stripe processes approved refunds from the provider’s connected balance. If that balance is insufficient, Stripe may hold the refund pending until funds become available.
- For an approved refund, the customer receives the full amount approved by the provider. Because MIMO charges no service-payment commission, there is no MIMO application fee to retain or return. The provider’s connected balance funds the approved refund, and Stripe processing fees may remain the provider’s responsibility.
- MIMO changes the job’s paid amount and refund status only after Stripe confirms the result. Duplicate charges, fraud, payment errors, chargebacks, and refunds required by law may be addressed outside the ordinary window.
- Chargebacks and payment disputes are governed by Stripe and the card or payment network. The provider is responsible for service evidence, refund obligations, disputes, and negative balances related to the provider’s direct charges.
Provider subscriptions and plan entitlements
MIMO is completely free for an independent provider using one business account. Free includes the full solo-provider toolkit, unlimited active services, customer discovery, booking, scheduling, customer management, Stripe payments and refunds, reviews, job photos, business records, and audit history. A provider pays MIMO only if the provider voluntarily subscribes to an optional collaboration plan for a business or team that needs multiple business users. Paid subscriptions automatically renew at the chosen monthly, quarterly, or annual interval until canceled. Billing interval changes the subscription charge and renewal date, not the collaboration features included with that plan.
| Plan | Current collaboration capacity |
|---|---|
| Free | 1 total business user; complete solo-provider toolkit |
| MIMO Pro | Up to 3 total business users with shared staff access |
| MIMO Business | Up to 15 total business users with shared staff access |
| MIMO Teams | Up to 50 total business users with shared staff access |
A business owner may cancel an optional collaboration plan anytime through MIMO. Cancellation takes effect at the end of the current paid period and collaboration seats remain available through that date. Subscription charges are nonrefundable and non-prorated except where required by law or when MIMO corrects a duplicate charge or MIMO billing error. When a business returns to Free, its services, jobs, customers, audit history, photos, and other solo-provider tools remain available; additional team members lose business access until the owner resubscribes or reduces the business to one user.
Prices, taxes, and customer agreements
Providers set service prices and are responsible for applicable taxes, invoices, disclosures, and customer agreements. The final agreed price recorded by MIMO controls once payment begins. A material change to price or scope requires customer agreement and, when payment has already opened, a new or updated Stripe payment flow. MIMO does not retroactively change a locked charge.
User content, reviews, and private records
You keep ownership of content you submit. You grant MIMO a limited, nonexclusive license to host, copy, process, and display it only as needed to operate, secure, support, and improve MIMO and to show it to the people you intended. Public profiles, listings, and reviews may be displayed in MIMO and used to describe or promote the marketplace. MIMO does not acquire a license to publicly advertise with private messages, service addresses, exact locations, authentication records, payment records, refund records, nonpublic job photos, or a provider’s private customer records.
Only customers tied to a verified completed appointment may review it. Reviews must be truthful, relevant, based on first-hand experience, and must not contain threats, unlawful content, private information, or manipulated ratings. MIMO may remove content that violates these Terms, law, or another person’s rights.
MIMO intellectual property and third-party services
MIMO’s software, design, branding, documentation, and non-user content are owned by MIMO or its licensors. Subject to these Terms, MIMO grants you a limited, revocable, nontransferable right to use the service for its intended personal or internal-business purpose. You may not reverse engineer, copy, rent, sublicense, or create a competing service from protected parts of MIMO except where law expressly permits it.
MIMO links to or relies on services operated by others, including Stripe, Supabase, Expo, Vercel, Apple Maps, and Google Maps. Their services and terms are separate. MIMO is not responsible for third-party availability, content, or independent acts.
Availability, changes, and backups
MIMO may add, change, suspend, or discontinue features and does not promise uninterrupted or error-free operation. MIMO may maintain system backups but does not guarantee that every record can be restored. Users remain responsible for keeping independent copies of information they must retain. If MIMO discontinues the service entirely, it will provide reasonable notice and an export opportunity when practical and legally required.
Disclaimers and limitation of liability
To the fullest extent allowed by law, MIMO is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, noninfringement, service quality, provider suitability, or uninterrupted operation. MIMO is not responsible for the acts, omissions, safety, legality, quality, timing, or results of a provider or customer.
To the fullest extent allowed by law, MIMO is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, business, goodwill, data, or opportunities. MIMO’s total aggregate liability arising from MIMO or these Terms is limited to the greater of the amount you paid directly to MIMO during the twelve months before the event giving rise to the claim or US $500. Nothing excludes liability that law does not allow to be excluded or limited.
Indemnity
To the extent allowed by law, you will defend, indemnify, and hold harmless MIMO and its operator from third-party claims, losses, and reasonable costs arising from your services, your content, your business, your violation of these Terms or law, or your infringement of another person’s rights. This does not require a consumer to indemnify MIMO for MIMO’s own unlawful conduct.
Ending your account
You can stop using MIMO and delete your account from inside the app. Account deletion does not cancel, reverse, or erase completed payments, open refunds, chargebacks, tax obligations, legal claims, provider business records, or obligations that by their nature survive. MIMO may restrict, suspend, or terminate an account for breach, fraud, security risk, nonpayment, legal requirements, or harm to users or MIMO. Where reasonable and lawful, MIMO will explain the action and provide an opportunity to contact support.
Governing law and dispute resolution
These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict-of-law rules. Before starting arbitration or litigation, the claimant must send a written notice describing the dispute and requested relief and allow 30 days for informal resolution.
Except for an eligible individual small-claims case, a claim for temporary or injunctive relief, or a claim that cannot lawfully be arbitrated, disputes will be resolved individually through binding arbitration in Montgomery County, Tennessee. If a dispute proceeds in court, the state and federal courts serving Montgomery County, Tennessee have exclusive jurisdiction, except where consumer law requires another venue. Claims must be brought individually and not as a class, collective, consolidated, or representative action to the extent the law allows.
If any part of this dispute provision is unenforceable for a particular claim or remedy, that part will be severed and the remainder will continue to apply. Nothing in this section prevents either party from reporting a matter to a government agency.
Changes to these Terms
MIMO may update these Terms prospectively. Material changes will be announced by email, in-app notice, or another reasonable method before taking effect when required by law. Security updates, bug fixes, new optional functionality, and changes required by law or court order may take effect immediately. Continued use after the effective date means acceptance; if you do not agree, stop using MIMO and close the account before the change takes effect.
General terms
These Terms, the Privacy Policy, the Refund and Cancellation Policy, and any plan or checkout terms shown before purchase form the agreement about MIMO. Marketplace-specific language controls over conflicting generic purchase, order, payment, tax, refund, subscription, or user-content language. If one provision is unenforceable, the remaining provisions continue. A failure to enforce a provision is not a waiver. You may not assign your account or these Terms without MIMO’s consent; MIMO may assign them as part of a reorganization, financing, or transfer of the service.
